Why can't a person be put in jail if they are stalking someone and the victim has reasonable evidence?

For example if a person were to stalk on a judges family memeber can't that judge put him in jail for doing that to his family memeber if he has reasonable evidence?

They can be and have been, sometimes they are put in a mental hospital.

You need proof and witnesses.
Reply:Not without a trial. They would arrest them, then they would apply for bond, then there would be a trial.

Get an order of protection, carry it with you.

Get the state's attorney to press charges.
Reply:because its not a crime to follow someone, if that person is being provocotive in anyway then get a court order and have a restraining order put against him/her. that way they cant come within some many feet of you
